These Terms of Use (the “Terms,” also serving as the End User License Agreement) govern your use of Ask Donnie, a construction estimating and building-code assistant operated by Proctor Holdings (“we,” “us”), including our website and iOS app. By creating an account or using the app, you agree to these Terms.
License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for your own construction estimating and informational purposes, subject to these Terms. For the iOS app, your license is also subject to Apple’s Licensed Application End User License Agreement; where those terms and these Terms conflict for the iOS app, the more protective of your statutory rights applies.
Important — not professional advice
Ask Donnie is an AI assistant and can be wrong. Its code answers, quantity takeoffs, and cost estimates are informational only and are not engineering, architectural, legal, or professional advice. Building codes and their local amendments change and are interpreted by your local authority having jurisdiction (AHJ). Before you build, purchase materials, or rely on any output, you must verify critical details with your local building department (AHJ) and a licensed professional. You are solely responsible for your projects and decisions.
Subscriptions & auto-renewal
Paid memberships are offered as auto-renewable subscriptions. On iOS, payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically for the same period at the displayed price unless you cancel at least 24 hours before the end of the current period. You can manage or cancel anytime in your Apple Account settings (Settings → your name → Subscriptions). Prices are shown in the app before purchase; App Store prices include applicable platform fees and may differ from web pricing.
Wallet credit (top-ups)
Wallet top-ups are one-time purchases that add prepaid usage credit to your account. Each top-up adds the base dollar amount of credit stated in the product (for example, a “$20 Wallet Credit” adds $20.00 of usage credit). Your wallet and subscription tier are shared across our web and iOS apps. Credit is consumed as you use metered features and is non-refundable except where required by law.
Acceptable use
Don’t misuse the service: no unlawful use, no attempts to break security or rate limits, no reselling or scraping, and no uploading content you don’t have the right to use. You retain ownership of the content you upload; you grant us the limited rights needed to process and store it to provide the service.
No warranty
The service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that outputs are accurate, complete, code-compliant, or fit for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, Proctor Holdings is not liable for indirect, incidental, or consequential damages, or for any loss arising from reliance on the app’s output. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
Changes & termination
We may update these Terms; we’ll revise the “Last updated” date and, for material changes, give notice. We may suspend or terminate accounts that violate these Terms. You may stop using the service and delete your account at any time.
